Igness, Inc. ("the Company", "we", "our") sets out below its privacy policy ("this Policy") regarding the handling of users' personal information in the services we provide ("the Services").
Article 1 (Definition of Personal Information)
In this Policy, "personal information" means "personal information" as defined under Japan's Act on the Protection of Personal Information — information about a living individual that can identify the specific individual by name, date of birth, address, telephone number, contact details, or other descriptions contained in the information, as well as data such as facial features, fingerprints, voiceprints, or the insurer number of a health insurance card that can identify a specific individual on its own (personal identification codes).
Article 2 (How We Collect Personal Information)
We may ask users for personal information such as name, date of birth, address, telephone number, email address, bank account number, credit card number, or driver's license number when they register to use the Services. We may also receive transaction records and payment-related information containing users' personal information from our partners (information providers, advertisers, advertising distribution destinations, and so on — collectively "Partners").
Article 3 (Purposes of Collecting and Using Personal Information)
Our purposes for collecting and using personal information are:
- To provide and operate our Services
- To respond to inquiries from users (including identity verification)
- To contact users with necessary information such as maintenance notices
- To identify and decline service to users who violate our terms of use or who attempt to use the Services for fraudulent or improper purposes
- To allow users to view, modify, or delete their registration information and to view their usage status
- To bill users for paid services
- Any purpose incidental to the purposes above
Article 4 (Disclosure of Personal Information to Third Parties)
Except in the following cases, we do not provide personal information to third parties without the user's prior consent, except as permitted by the Act on the Protection of Personal Information and other laws.
- When necessary to protect the life, body, or property of a person and it is difficult to obtain the individual's consent
- When particularly necessary to improve public health or to promote the sound growth of children, and it is difficult to obtain the individual's consent
- When it is necessary to cooperate with a national authority, local government, or a party entrusted by them in carrying out statutory duties, and obtaining the individual's consent is likely to impede the execution of those duties
- When we have notified or announced the following items in advance and filed with the Personal Information Protection Commission:
- That the purpose of use includes provision to third parties
- The categories of data to be provided to third parties
- The means or method of provision to third parties
- That we will stop providing personal information to third parties upon the individual's request
- The method for accepting the individual's request
Article 5 (Disclosure of Personal Information)
When an individual requests disclosure of their personal information, we will disclose it without delay. However, if disclosure would fall under any of the following, we may decline to disclose all or part of it, and we will notify the individual of any decision not to disclose:
- Where disclosure could harm the life, body, property, or other rights or interests of the individual or a third party
- Where disclosure could significantly impede the proper conduct of our business
- Where disclosure would otherwise violate laws or regulations
Notwithstanding the above, as a rule we do not disclose non-personal information such as history or usage characteristics.
Article 6 (Correction and Deletion of Personal Information)
- Where personal information we hold about the user is incorrect, the user may request us to correct, add to, or delete their personal information ("Corrections") via the procedure we specify.
- Where we receive such a request and determine that we need to comply, we will promptly make the Corrections.
- We will promptly notify the user when we have made Corrections as above, or when we have decided not to.
Article 7 (Suspension of Use of Personal Information)
- Where an individual requests that we suspend or erase their personal information ("Suspension of Use") on the grounds that it is being handled beyond the scope of the purpose of use, or that it was obtained by improper means, we will promptly investigate as needed.
- Based on the results of that investigation, if we determine we need to comply, we will promptly carry out Suspension of Use.
- We will promptly notify the user of any Suspension of Use, or of a decision not to do so.
- Notwithstanding the preceding two paragraphs, where Suspension of Use would require substantial cost or is otherwise difficult, and where we can take alternative measures sufficient to protect the user's rights and interests, we may take those alternative measures instead.
Article 8 (Changes to This Privacy Policy)
- The content of this Policy may be changed without notice to users, except for matters stipulated by law or otherwise specified in this Policy.
- Unless we specify otherwise, the revised Privacy Policy becomes effective from the time it is posted on this website.
